What Is Aggressive Driving Under Arizona Law?
Under Arizona Revised Statutes (ARS) §28-695, “aggressive driving” has a broad definition that covers a variety of driver actions and behaviors that are deemed to be excessively dangerous. In Arizona, a driver commits aggressive driving if he or she engages in excessive speeding under §28-701, subsection A or section 28-701.02, plus two of the following:
- Failing to obey a traffic control device (e.g., running a red light)
- Unsafe passing
- Unsafe lane change
- Following another vehicle too closely (tailgating)
- Failing to yield the right-of-way
Although often used interchangeably, aggressive driving is different from reckless driving under Arizona law. While both are serious offenses that can result in criminal charges, reckless driving means to operate a vehicle in reckless disregard for the safety of persons or property (ARS §28-693). In general, this is a less serious offense than aggressive driving.
