What Is a DUI in Arizona?

Driving under the influence is criminalized in Arizona Revised Statutes § 28-1381. This law prohibits driving or being in actual physical control of a motor vehicle while under the influence of “intoxicating liquor, any drug, a vapor releasing substance containing a toxic substance or any combination.”

It is against the law to drive if “impaired to the slightest degree” in Arizona. However, if an individual has a blood alcohol concentration (BAC) level at or above 0.08 percent within two hours of driving, this is automatically grounds for a DUI. It is also illegal to drive while impaired by drugs in Arizona, including prescription medications.

Types of DUI Charges in Arizona

The penalties for a DUI conviction in Arizona can vary depending on the classification of the crime. Sentencing for those convicted often includes jail time, hefty fines, mandatory alcohol education courses, driver’s license suspension and required ignition interlock devices.

There are four types of DUI charges in Arizona:

  • Standard DUI: BAC between 0.08 and 0.15 percent
  • Extreme DUI: BAC between 0.15 and 0.20 percent
  • Super Extreme DUI: BAC of 0.20 or higher
  • Aggravated DUI: DUI on a suspended license, with someone under the age of 15 in the vehicle or other aggravating factors

Most DUI charges in Arizona are class 1 misdemeanors. However, the charges can be upgraded to a felony for an aggravated DUI or a repeat offender with three or more offenses within seven years.

Defending Against a DUI in Arizona

Many potential defenses can be used to fight DUI charges in Arizona, depending on the circumstances. Examples include improper traffic stop or arrest, lack of probable cause, incorrect BAC test results, inaccurate field sobriety test results, and no actual physical control of a vehicle. Our lawyers will tailor your defense strategy to your unique situation to achieve the best possible results.
